OVERVIEW

Welcome to DYNVOR.

The terms “DYNVOR,” “we,” “us” and “our” refer to DYNVOR.

DYNVOR operates this website and online store, including the related information, content, features, tools, products and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce infrastructure that enables us to offer the Services.

These Terms of Service, together with the policies referenced in them, explain the rights and responsibilities that apply when you:

access or browse our website;
create or use a customer account;
place an order;
purchase a product;
communicate with DYNVOR; or
otherwise use the Services.

By accessing or using the Services, you agree to these Terms of Service and our applicable policies.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms is intended to exclude or limit any rights that cannot lawfully be excluded under applicable consumer-protection laws.

SECTION 1 — ELIGIBILITY, ACCESS & ACCOUNTS

You must be legally capable of entering into a binding transaction in your jurisdiction to place an order through the Services.

Where applicable, a parent or legal guardian is responsible for the use of the Services by a minor under their supervision.

When using the Services, you may be asked to provide information including:

your name;
email address;
telephone number;
billing information;
delivery address; and
payment information.

You agree that information provided to DYNVOR will be accurate, current and complete.

If you create a customer account, you are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for activity conducted through your account unless otherwise required by applicable law.

You must not:

impersonate another person;
use another person's payment information without authorisation;
provide materially false information; or
use the Services for unlawful or fraudulent purposes.

SECTION 2 — PRODUCTS

DYNVOR makes reasonable efforts to describe and display products accurately.

Product information may include:

product photographs;
artwork previews;
colours;
materials;
garment measurements;
fit information;
product specifications;
prices; and
availability.

However, the appearance of products on a screen may vary because of factors such as:

device settings;
display calibration;
lighting;
photography;
fabric texture;
garment construction;
printing processes; and
normal production variations.

Minor variations that do not materially affect the product are not necessarily defects.

Certain DYNVOR products may be produced, printed, embroidered or otherwise prepared after an order is placed.

Product descriptions, specifications and availability may be updated where reasonably necessary.

DYNVOR may discontinue, modify or limit the availability of products at any time, subject to applicable law and existing confirmed orders.

SECTION 3 — PRODUCT SIZING

Customers are responsible for selecting the appropriate product and size before completing an order.

Where relevant, DYNVOR provides a Size + Fit Guide on the product page.

We recommend comparing the listed garment measurements with a similar garment you already own and prefer.

Different product categories may use different fits, including:

oversized fits;
regular fits;
sleeveless athletic fits; and
tapered jogger fits.

Normal manufacturing tolerances may result in minor measurement variations.

Where the correct size ordered by the customer is supplied, eligibility for a return or exchange is governed by our Return, Refund, Exchange & Cancellation Policy and applicable law.

SECTION 4 — ORDERS

When you submit an order, you are making an offer to purchase the products included in that order.

Receipt of an order confirmation does not necessarily mean that the order has already entered production or been dispatched.

DYNVOR may, where reasonably necessary and permitted by applicable law:

accept or decline an order;
request additional information;
verify payment or delivery information;
cancel an order that cannot be fulfilled;
cancel an order affected by an obvious pricing or technical error; or
limit quantities in cases of suspected misuse, fraud or unauthorised resale.

If an order cannot be accepted or fulfilled after payment has been successfully received, any eligible payment will be handled appropriately in accordance with applicable circumstances and law.

Please review your order carefully before submitting it.

Once production, printing, fulfilment or shipping has progressed, DYNVOR may be unable to accommodate a cancellation or modification request.

SECTION 5 — PRICES, TAXES & BILLING

Prices displayed through the Services may be changed from time to time.

The applicable price for an accepted order will generally be the price shown when the order is submitted, subject to correction of obvious technical, typographical or pricing errors where permitted by law.

Applicable:

taxes;
shipping charges;
discounts; and
other checkout charges

will be shown where relevant before the transaction is completed.

You agree to provide accurate and authorised payment information for purchases made through the Services.

You represent that you are authorised to use the payment method provided.

DYNVOR may use third-party payment providers to process transactions securely.

Payment processing may therefore also be subject to the terms and policies of the applicable payment provider.

SECTION 6 — PAYMENT METHODS

Available payment methods are displayed during checkout and may include supported options such as:

UPI;
debit or credit cards;
net banking;
wallets;
EMI;
prepaid payment methods; and
Cash on Delivery, where eligible.

Availability may vary depending on the transaction, location, checkout configuration and payment provider.

DYNVOR does not guarantee that every payment method will be available for every order.

SECTION 7 — CASH ON DELIVERY & PARTIAL COD

Cash on Delivery (COD) may be offered for eligible orders and serviceable locations.

COD eligibility may depend on factors such as:

delivery location;
order characteristics;
courier support;
order value; and
applicable checkout eligibility or risk controls.

Some eligible COD orders may require a partial online payment before the remaining balance is collected on delivery.

Where partial COD applies, the required upfront amount will be displayed during checkout.

The treatment of a partial payment following:

cancellation;
failed delivery;
refusal of delivery;
RTO; or
an approved refund

will depend on the circumstances, our applicable policies and applicable law.

SECTION 8 — SHIPPING & DELIVERY

Shipping, production, processing and delivery timelines shown through the Services are estimates and not guaranteed delivery dates.

Our current standard estimated delivery timeframe is generally 4–7 business days, although this may vary.

Delivery may be affected by:

production requirements;
order volume;
courier operations;
destination serviceability;
weather;
public holidays;
transportation disruptions; or
circumstances outside our reasonable control.

Shipping charges, free-shipping eligibility, tracking, failed delivery, RTO shipments and other delivery matters are governed by our Shipping Policy.

SECTION 9 — RETURNS, REFUNDS, REPLACEMENTS & CANCELLATIONS

Returns, refunds, exchanges, replacements and cancellations are governed by our:

Return, Refund, Exchange & Cancellation Policy

Some DYNVOR products may be produced or printed specifically following an order. For this reason, change-of-mind returns or incorrect-size selections may not ordinarily qualify for return or refund, except where required by applicable law or otherwise approved by DYNVOR.

Eligible issues may include circumstances such as:

damaged products;
defective products;
materially incorrect printing;
incorrect products supplied; or
an incorrect size supplied by DYNVOR.

SECTION 10 — RETURN TO ORIGIN (RTO)

An order may become a Return-to-Origin (RTO) shipment where delivery cannot be completed because of circumstances including:

incorrect delivery details;
incomplete address information;
customer unavailability;
unsuccessful delivery attempts;
inability to contact the customer; or
refusal to accept delivery.

An RTO shipment is not automatically eligible for a refund.

Where appropriate and permitted by applicable law, additional shipping or handling charges may apply to a reshipment.

RTO matters are governed by our Shipping Policy and Return, Refund, Exchange & Cancellation Policy.

SECTION 11 — INTELLECTUAL PROPERTY

Unless otherwise stated, the Services and their original content are owned by or licensed to DYNVOR.

This includes, where applicable:

the DYNVOR name;
logos;
brand identity;
D/V Motion Mark;
product artwork;
graphics;
product designs;
photographs;
campaign imagery;
videos;
written content;
website design;
slogans; and
other original materials.

These materials may be protected by applicable copyright, trademark and other intellectual-property laws.

Except where permitted by law or with prior written permission from DYNVOR, you must not:

reproduce;
copy;
modify;
republish;
distribute;
commercially exploit;
sell;
license; or
create derivative works from

protected DYNVOR materials.

No use of the Services grants you ownership of any DYNVOR intellectual property.

Shopify and other third-party names, trademarks, logos and services remain the property of their respective owners.

SECTION 12 — REVIEWS, FEEDBACK & USER CONTENT

If you submit content to DYNVOR such as:

product reviews;
photographs;
feedback;
suggestions;
comments; or
other materials,

you represent that you have the right to provide that content.

You must not submit content that:

infringes another person's rights;
is knowingly false or misleading;
is unlawful;
contains malicious software;
unlawfully discloses personal information; or
impersonates another person.

Where legally permitted, by submitting content intended for publication or promotional use, you grant DYNVOR a non-exclusive, worldwide licence to use, reproduce, display and distribute that content for purposes connected with operating, improving and promoting DYNVOR and the Services.

Where a review, testimonial or creator collaboration involves compensation, gifted products or another incentive, applicable disclosures may be required.

DYNVOR may moderate or remove content where reasonably necessary and permitted by law.

SECTION 13 — OPTIONAL & THIRD-PARTY TOOLS

The Services may make available functionality provided by third parties.

Examples may include:

payment services;
checkout functionality;
customer reviews;
analytics;
tracking services;
marketing integrations;
shipping tools; and
other applications.

DYNVOR does not necessarily control every feature or service operated independently by those providers.

Use of third-party tools may therefore also be governed by the provider's own:

terms;
privacy policies; and
operating conditions.

You should review relevant third-party terms where appropriate.

SECTION 14 — THIRD-PARTY LINKS

The Services may contain links to websites or services operated by third parties.

DYNVOR does not control independent third-party websites and is not responsible for their:

content;
availability;
privacy practices;
security; or
terms.

Accessing an external website is at your discretion.

Before entering into a transaction with a third party, review that party's applicable terms and policies.

SECTION 15 — RELATIONSHIP WITH SHOPIFY

DYNVOR's online store is powered by Shopify.

Shopify provides ecommerce infrastructure that enables DYNVOR to operate the store.

Purchases made from the DYNVOR store are transactions between the customer and DYNVOR, not purchases from Shopify.

Shopify may process information relating to your access to and use of the Services as described in applicable Shopify privacy documentation.

SECTION 16 — PRIVACY

Personal information collected or processed through the Services is handled in accordance with our Privacy Policy.

Because our store uses Shopify and other authorised service providers, information may also be processed by those providers as necessary to deliver their respective services.

By using the Services, you acknowledge that relevant information may be processed in accordance with the applicable privacy policies and legal requirements.

SECTION 17 — ERRORS, INACCURACIES & OMISSIONS

Occasionally information available through the Services may contain:

typographical errors;
inaccuracies;
incomplete information; or
technical errors.

These may relate to matters such as:

product descriptions;
prices;
promotions;
availability;
delivery estimates;
shipping charges; or
product specifications.

Where reasonably necessary and legally permitted, DYNVOR may correct such information.

If a material error affects an order, we may contact the customer to provide an appropriate resolution.

Nothing in this section limits rights that cannot lawfully be excluded.

SECTION 18 — PROHIBITED USES

You must not use the Services:

for unlawful purposes;
to commit fraud;
to impersonate another person;
to infringe intellectual-property rights;
to harass, abuse or threaten others;
to transmit malicious code;
to obtain unauthorised access to systems;

to circumvent technical restrictions;

to place fraudulent orders; or
in a manner that materially disrupts the Services.

You must not reproduce, scrape, extract or commercially exploit substantial portions of the Services in violation of applicable law or DYNVOR's rights.

DYNVOR may restrict access to the Services where reasonably necessary to protect:

customers;
the business;
infrastructure;
intellectual property; or
legal rights.

SECTION 19 — AUTOMATED SYSTEMS & AGENTS

Automated tools, agents, bots or similar systems must not access or interact with the Services in a manner that:

bypasses security controls;
circumvents access restrictions;
misrepresents automated activity as authorised human activity;
interferes with website operation; or
violates applicable law or these Terms.

DYNVOR may implement technical measures to limit automated access where reasonably necessary for security, performance or protection of its legitimate interests.

This section does not prohibit legitimate search engines, accessibility technologies or other authorised systems operating in accordance with applicable rules and technical standards.

SECTION 20 — SUSPENSION OR TERMINATION OF ACCESS

DYNVOR may restrict or terminate access to the Services where reasonably necessary because of:

fraud;
abuse;
unlawful activity;
security threats;
material violation of these Terms; or
conduct that materially harms DYNVOR, customers or third parties.

Termination of access does not remove obligations or rights that arose before termination.

Provisions that by their nature should continue after termination will remain effective.

SECTION 21 — DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, the Services are provided on an “as available” basis.

DYNVOR makes reasonable efforts to maintain accurate, secure and functional Services, but we do not guarantee that:

the website will always be uninterrupted;
all content will always be error-free;
every feature will always be available; or
technical problems will never occur.

Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot lawfully be excluded.

SECTION 22 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, DYNVOR will not be liable for indirect, incidental, special or consequential losses arising solely from use of the Services where such liability can lawfully be limited.

However, nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

This includes rights and remedies available under applicable consumer-protection legislation.

SECTION 23 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, claims or liabilities reasonably resulting from:

your unlawful use of the Services;
your material breach of these Terms;
your infringement of another person's rights; or
fraudulent or malicious activity carried out through your account.

This section does not impose liability beyond what is permitted under applicable law.

SECTION 24 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.

If that is not possible, the affected provision may be severed.

The remaining provisions will continue in effect.

SECTION 25 — WAIVER & ENTIRE AGREEMENT

A failure by DYNVOR to immediately exercise or enforce a right under these Terms does not automatically waive that right.

These Terms, together with the policies and terms incorporated by reference, form the agreement governing your use of the Services.

Where a specific promotion or offer has separate terms, those specific terms may apply to that promotion.

SECTION 26 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms where such transfer would be unlawful or materially affect DYNVOR without our consent.

DYNVOR may transfer or assign its rights and obligations where reasonably necessary in connection with a legitimate business transaction, restructuring or operation of the Services, subject to applicable law.

SECTION 27 — GOVERNING LAW

These Terms of Service and applicable transactions with DYNVOR are governed by the laws of India, subject to any mandatory consumer-protection rights or other laws that apply to the customer.

Nothing in these Terms is intended to deprive a customer of rights or remedies that cannot lawfully be waived.

Subject to applicable consumer-protection laws and other mandatory legal rights, disputes concerning these Terms or the Services may be subject to the jurisdiction of the competent courts associated with DYNVOR's principal place of business.

SECTION 28 — CHANGES TO THESE TERMS

DYNVOR may update these Terms from time to time to reflect changes to:

the Services;
operations;
policies;
technology;
payment or fulfilment processes;
applicable laws; or
regulatory requirements.

The current version will be made available on this website.

Where required by applicable law, material changes will be communicated appropriately.

The Last updated date at the beginning of these Terms identifies the latest revision.
